These Terms and Conditions of Use define the terms and conditions under which WEPAY provides Users with the technological tools and information necessary to use the Services offered on the Tap-to-Pay Application named “TAPPY” by WEPAY, available free of charge on Google’s “Google Play Store”. Any use of the Application is subject to compliance with and acceptance of these Terms and Conditions of Use.

The Publisher reserves the right to modify, at any time, these Terms and Conditions of Use to adapt them to changes in the Application and/or its operation. Modifications to the Terms and Conditions of Use will be communicated to the User two (2) weeks before their entry into force; they will take effect immediately after this period.

The Terms and Conditions of Use are valid for an indefinite duration.

The terms and expressions referred to below shall have the following meanings within the framework hereof:

• Administrator: Refers to the person with access to the Administrator Account on the WEPAY dashboard.
• Platform or Solution or Application: Refers to the Company’s software application, its updates, and new versions, published and provided by WEPAY for combined use with certain card reader models, enabling in particular the use of payment services offered by WEPAY. It is available free of charge in Google’s “Google Play Store” to be downloaded by any client on a mobile phone, tablet, or device equipped with a compatible Android operating system (version 11 or higher; the latest version is recommended and sometimes required) with an Internet connection and NFC (Near-Field Communication) technology.
• Terms and Conditions of Use: Refers to these general terms of use of the Application applicable to Users.
• Merchant Account: Refers to the environment on the Application to which a User has access via unique identification credentials (username, password) allowing the User to:
  1. perform payment acceptance operations,
  2. perform a payment cancellation operation for the last transaction,
  3. consult transactions,
  4. generate and share payment receipts.
• WEPAY Internet Portal Account: Refers to the web portal solution accessed by a Merchant User via unique credentials (username and password), allowing them to view detailed transactions made via their WEPAY payment terminal(s), access advanced analytics dashboards, activate or deactivate terminals, and manage users.
• Personal Data: Refers to data that, under data protection regulations, directly or indirectly identifies a natural person.
• Intellectual Property Rights: Refers to all intellectual property rights as provided by copyright law and international conventions, including copyrights, derivative rights, trademark rights, patents, trade names (including domain names and email addresses), and copyrights.
• Publisher or Service Provider: Refers to WEPAY Inc as the publisher of the Application.
• Acquirer: Refers to WEPAY’s partner carrying out merchant acquiring activities for the payment acceptance service.
• User(s): Refers to any natural or legal person using the Application through a Merchant Account.
• Terminal(s): Refers to payment terminals assigned to the Merchant to accept contactless card payments.
• Service(s): Refers to the means and functionalities made available to the User.
• Web Portal: Refers to the website accessible at: https://dashboard.we-pay.io
• Website: Refers to WEPAY Inc’s website at: https://we-pay.io
• Company: Refers to WEPAY, a limited liability company registered under number 1863975F, headquartered at 10-B04, Asdrubal Avenue, Cite La Gazelle, Ariana 2083, Tunisia.

Access to the Application is reserved for legally capable natural persons representing the Merchant, Users of the “TAPPY” Application.

Account creation is initiated by the Administrator via the Web Portal. Authentication requires username, password, and an OTP code sent via SMS/Email. Credentials must be kept strictly confidential.

Users agree to comply with applicable laws, refrain from fraudulent activity, data mining, uploading malicious software, or interfering with infrastructure security.

The Administrator, Publisher, or Acquirer may suspend or terminate Merchant Accounts for breach of T&Cs, provision of false info, illicit activities, money laundering suspicion, or threats against staff.

All code, algorithms, visual design, content, and trademarks belong exclusively to WEPAY Inc.

Personal data is processed in compliance with applicable privacy regulations. WEPAY is authorized to collect transaction data to deliver and improve services.

Information provided is believed to be accurate but may contain technical errors. The Publisher is not liable for indirect damages or misuse of the Application.

Governed by Tunisian law. Disputes shall first be resolved amicably within 3 months, failing which they will be referred to Tunisian courts. Contact: info@we-pay.io.
